The following indictments were returned by a 3rd Judicial District Court grand jury on Jan. 3:James Kenneth Goodwin, 26, 4446 1/2 Tornillo or 1446 1/2 Gonzalez, Las Cruces, is charged with trafficking and possession of marijuana on Dec. 4.
Gary Figueroa, 33, 910 S. Esperanza or 1111 Chaparro, Las Cruces, is charged with possession of a controlled substance on Aug. 14.
assault upon a peace officer, aggravated driving while under the influence of intoxicating liquor and/or drugs, no driver's license and open container on Dec. 29. District attorney lists no prior DWI convictions.
Rodman Lee, 48, New Mexico Dept. of Corrections, Santa Fe, is charged with escape or attempt to escape from the penitentiary, conspiracy to commit escape or attempt to escape from the penitentiary, attempt to commit a felony, to wit: Unlawful taking of a motor vehicle and criminal damage to property on Feb. 1, 2006.
Jonathan Balderrama, 19, 505 Curry Court, Anthony, is charged with distribution of marijuana and conspiracy to commit distribution of marijuana on June 8.
Shawn Brian Nevels, 35, 606 Conway, Las Cruces, is charged with trafficking and possession of drug paraphernalia on Jan. 4.
Gregory Cleo Fernandez, 31, 119 Gallagher Ave., Las Cruces, is charged with distribution of marijuana, possession of a controlled substance and possession of drug paraphernalia on Dec. 11.
Joe Roberto Pino, 47, P.O. Box 462 or 421 Wilson St., Hatch, is charged with aggravated driving while under the influence of intoxicating liquor and/or drugs, driving while license suspended or revoked, operating vehicle without required headlamps, expired registration plate and open container on Oct. 28. District attorney lists three prior DWI convictions.
Jose A. Gonzalez, 54, Rt. 1 Box 457, La Mesa or Community of Hope, Las Cruces, is charged with aggravated driving while under the influence of intoxicating liquor and/or drugs, driving while license suspended or revoked, speeding, no proof of insurance, expired registration and open container on Jan. 5. District attorney lists 10 prior DWI convictions.
Samuel Pinedo-Torres, 48, 805 N. 17th St. or 523 N. Solano, #4, Las Cruces, is charged with aggravated driving while under the influence of intoxicating liquor and/or drugs, driving while license suspended or revoked, careless driving and no proof of insurance on Nov. 19. District attorney lists six prior DWI convictions.

Ernest Donald Drift Jr., 47, was sentenced Friday in Douglas County Circuit Court for operating a motor vehicle Aug. 7 while under the influence for the eighth time. He pleaded no contest to the charge in November.
Judge Michael Lucci ordered Drift to spend 18 months initial confinement in Wisconsin State Prison with an additional 24 months of extended supervision. Conditions of extended supervision include undergoing a chemical dependency evaluation, maintaining absolute sobriety, not entering any establishment where the primary business is the sale of alcohol, providing a DNA sample and paying a $600 fine.

Martin Rocha, age 42, is charged in a four-count indictment accusing him of distributing hundreds of grams of methamphetamine over a 14-month period from 2006-08. Martin Rocha-Miranda, 42, is charged in a two-count indictment involving fraud and identity theft in connection with a Jan. 9 incident.
The indicted men are “definitely two different and distinct individuals,” U.S. Attorney Joe Stecher said Thursday afternoon.
“We’ve got both men in custody,’’ Stecher said.
Martin Rocha is accused of conspiring with others to distribute and possess with intent to distribute 500 grams or more of methamphetamine from Nov. 1, 2006, to Jan. 10. The maximum penalty includes imprisonment of 10 years to life, a $4 million fine, at least five years of supervised release and a $100 special assessment.
Count two of the indictment charges Martin Rocha with distributing 50 grams or more of methamphetamine on or about Jan. 4. The maximum penalty includes imprisonment of up to 20 years, a $1 million fine, at least 3 years of supervised release and a $100 special assessment.
Count three charges the defendant with distributing less than 50 grams of meth on or about Jan. 5. The maximum penalty includes imprisonment of up to 20 years, a $1 million fine, at least 3 years of supervised release and a $100 special assessment.
The final count charges the defendant with illegal re-entry into the U.S. on or about Jan. 5 after deportation or removal after a conviction for an aggravated felony. The maximum penalty, if convicted, includes imprisonment of up to 10 years, a $250,000 fine, 3 years of supervised release and a $100 special assessment.
Martin Rocha-Miranda is charged with fraud and misuse of visas, permits and other documents in January. The maximum penalty for this count includes imprisonment of 10 years, a $250,000 fine, 3 years of supervised release and a $100 special assessment.
A second count of the indictment charges the defendant with aggravated identity theft on or about Jan. 8. The maximum penalty includes imprisonment for two years consecutive to any other term of imprisonment imposed on Count I of the indictment, a $250,000 fine, one year of supervised release and a $100 special assessment.

Mazzuchi, Brendan Flory, 18, and Allissa Hovik, 19, were arrested on drug charges when authorities searched Mazzuchi's Flat Rock Trace residence, the release states.
Christopher Nicolosi, 19, and Anthony Mazzuchi, 21,were connected to drug-related activity, according to the release.
Nicolosi was later found at 10 Anchorage Point on Hilton Head, allegedly carrying a handgun, the release states.
Officers seized marijuana, prescription drugs and other narcotics, scales, three handguns, a long gun and $1,880 in U.S. currency, according to the release.
Flory and Hovik were both charged with simple possession of marijuana. Mazzuchi was charged with simple possession of marijuana and possession with intent to distribute a narcotic.
Nicolosi was charged with:
Three counts of sale and distribution of marijuana.
Unlawful carrying of a firearm.
Two counts of possession of a firearm by a person under 21.
Possession of a firearm with an obliterated serial number.
Possession of a stolen firearm.

Amy Fox was jailed for five years after being found with 1.27 kilos of cocaine at Heathrow Airport.
The 20-year-old was recruited by an Edinburgh drugs gang to bring the coke - worth £72,000 - from Gambia in west Africa.
The former North Berwick High School pupil was jailed at Isleworth Crown Court after admitting smuggling the drugs.
Neighbours say that Amy is a bright young woman from a respectable family who fell into the wrong company.
Friends say that her spiral from fun-loving schoolgirl to international drugs mule began when she became friends with a youth from a local criminal family.
The 19-year-old is serving two years in jail for an axe attack in September inside Haddington Sheriff Court. Amy started dabbling in drugs when they met around four years ago.
A friend said: "It's a tragedy. Amy is an intelligent and funny girl from a nice family.
"But she met a bad bunch of people and started dabbling in drugs and got involved in the drugs scene in Edinburgh.

"She was a bit naive and vulnerable at the time and got caught up in something she shouldn't have. It's tragic she has been sent to prison but I guess it's a lesson to others."

Another friend said: "Amy was duped by these really evil people and used to bring drugs back to Britain. This family were the start of Amy's ruin.

"They've made life hell for everyone in North Berwick and are despised."

Amy was promised £5000 to take the drugs into the UK from Gambia, a popular winter sunshine holiday resort.

Corey Flagg is a former Chicago Police officer headed to prison in about two weeks to serve a 9½-year sentence for robbing drug dealers.
But on Jan. 11 he was playing cop again.
Chicago Police think he made an anonymous 911 call tipping officers that a car parked near 107th and Wentworth contained drugs.
"That is the car," Flagg yelled to officers from a white Ford Thunderbird before driving off, according to a police report.
The officers searched the car, but didn't find any drugs or make any arrests. They recognized Flagg and reported him to their superiors, who notified the feds.
Federal authorities don't suspect he was doing anything nefarious, like trying to set up a rival. They just think he was trying to help the police.

Matthew Sheridan, 42, was convicted of making and trying to make at least five grams of pure meth.A resort security guard entered Sheridan’s pool-side room July 20, 2006, and smelled a strong chemical. The guard told two employees he found Sheridan was making meth in the room. Law enforcement was notified.
Officers found a tray with a piece of burned aluminum foil and white powder and a snort tube under a pillow. Two small bags of white powder were found on Sheridan.Officers discovered chemicals, tubing and containers used to make meth, as well as 27 grams of marijuana, two bags with 12.58 grams of meth, several unused bags and a shotgun shell.
He will have four years of supervised release after his prison term.


David Faustino

a drug charge dropped against actor David Faustino, best known for playing Bud Bundy on the TV series "Married With Children."
Faustino was charged in May with misdemeanor marijuana possession after he was arrested during an argument with his estranged wife.
Officers who intervened in the couple's argument said Faustino's breath smelled of alcohol, and he had a plastic bag containing a gram of marijuana in his pocket.
A disorderly intoxication charge was dismissed soon after the arrest, and Faustino agreed to complete a drug treatment program.
Faustino completed the treatment program in California, where he lives. His attorney said the actor received no special treatment from prosecutors.

U.S. Border Patrol agent is dead

A U.S. Border Patrol agent is dead in California after being struck by one of two vehicles fleeing toward the U.S.-Mexico border during a pursuit by law enforcement today.
The officer, whose name has not yet been released, was laying spike strips across the road in the Imperial Sand Dunes recreation in the southeast portion of the state at about 9:30 a.m. when he was hit by a Hummer believed to have been driven by smugglers.
The Hummer and a Black Ford F-150 pickup truck escaped into Mexico, Supervisory Border Patrol Agent Jeremy Schappell told the Yuma Sun. It is unknown whether the vehicles were carrying drugs or human contraband.


Five drug smugglers were killed

Five drug smugglers were killed and two Anti-Narcotics Force (ANF) personnel suffered injuries in an encounter in Chagai district near the Pakistan-Afghan border on Saturday.
The security personnel recovered large quantities of morphine and illegal arms.
According to official sources, the ANF personnel had received a tip-off about the movement of drug smugglers in Jitral area and conducted a raid late in the night. The smugglers opened fire on the force. ANF personnel, who had taken up positions in the area before hand, returned fire. The heavy exchange of fire lasted around an hour and resulted in the killing of five smugglers and injuries to two ANF personnel.
However, other smugglers managed to escape, taking advantage of darkness in the area. ANF seized two vehicles loaded with drugs.
“Around 1,500kg of fine-quality morphine was recovered from the two vehicles,” sources said, adding that the consignment had been brought into the country from across the border and was destined for the Gulf States and Europe.
Sources said the ANF also seized arms and ammunition, including AK-47 rifles, rocket launchers, several thousands of rounds, satellite phones and wireless sets.
A case was registered against the smugglers.
